There are two essential documents: theétat descriptif de division (EDD) and the co-ownership regulations.
These two documents are often drawn up in a single deed by a notary.

The descriptive statement of division (EDD)

This is a notarial deed, the purpose of which is to register each lot with the land registry by describing the private parts, the common parts and by setting the tantièmes of the common parts attached to each lot. This document is essential; without it, the building cannot be subject to co-ownership.

The co-ownership regulations

These are a contractual document between the co-owners, whose purpose is to define the rules that apply between them. They determine the use of the property, both private and communal, the conditions of enjoyment, the rules governing the administration of the communal areas, the share of the co-ownership charges for each lot, etc.....
Although these rules are very important, they are not essential for all co-ownerships; some do not even have them. This is often the case for small co-ownerships with just a few lots. In such cases, only the provisions of the law of 10 July 1965 apply.

Where they do exist, the co-ownership regulations are an essential document that must be given to purchasers in advance. Ideally, this should be done before the compromis is signed, as some of the clauses may be restrictive for co-owners, and it is essential that the buyer signs with full knowledge of the facts.
