Question:

In the deed of purchase for my mountain chalet, there is an old servitude of passage "for all uses and all vehicles" for my benefit.

I want to buy a bigger car than the one I already have, but the passage is so narrow that the size of the car will no longer fit (I risk falling into the ravine).

Can I make any adjustments?

Answer:

You can make changes to allow access for your car, but all within the limits of the existing easement: it's simply a question of adapting your easement to current needs. Your neighbour will not be able to object.

The work will, of course, be at your expense (unless the wording of the easement in your deed of purchase provides for the costs to be shared out differently).
