Even if the purchaser of a life annuity property is free to resell it at any time, they are still obliged to pay the annuity to the surviving annuitant.
It is impossible to impose a change of debtor on a creditor. As a result, the purchaser of a life annuity cannot be exempted from paying the annuity, even if the new purchaser has undertaken to pay the life annuity in place of the original purchaser.
For there to be a dischargeable substitution vis-à-vis the first life annuity purchaser, the creditor of the arrears must intervene in the deed of sale or gift to expressly discharge the initial debirentier.
The resale of a house or flat purchased as a life annuity therefore requires the intervention of the creditor to ensure that there is full delegation.
